Store Usage Agreement

Note: Prices shown on this website apply only to online purchases through the e-store and do not apply to direct or in-store sales.

Introduction

Our e-store welcomes you and informs you that the following terms and conditions govern your use of this store and all legal consequences arising from such use.

Any person using the store, whether as a consumer of products or services or otherwise, is deemed to have accepted this Agreement.

This Agreement becomes valid and effective as soon as you agree to it and complete registration on the store, in accordance with the applicable Saudi Electronic Transactions Law.

Article I: Definitions

• Store: Includes all forms of the online store, whether an application, a website, or a commercial store.
• Consumer: Any person who engages in e-commerce through the store’s electronic platform to obtain products or services.
• Agreement: The terms and conditions that govern and regulate the relationship between the store and the consumer.

Article II: Consumer Legal Capacity

• The consumer acknowledges that they have full legal capacity to deal with the store, or that they are at least eighteen (18) years of age.
• In case of any breach of this Article, the consumer shall bear all resulting consequences towards third parties.

Article III: Nature of Obligation

• The store’s obligation towards the consumer is to provide the requested product or service through the electronic platform.
• The store may also provide additional services, such as after-sales services or other related services, depending on the nature and type of the product or service.

Article IV: Usage Rules

• The consumer is obliged to use the store’s electronic platform in accordance with public morals and the applicable laws and regulations of the Kingdom of Saudi Arabia.
• When purchasing any product or service from the store, the consumer is obliged not to use such product or service in violation of public morals or Saudi laws and regulations.

Article V: Accounts and Registration Obligations

• Upon registering for membership in the store, the user must provide specific information and choose a username and password to access store services.
• The user is responsible for maintaining the confidentiality of account and password information and agrees to notify the store immediately of any unauthorized use or security breach.
• Under no circumstances shall the store be liable for any direct or indirect, moral or material loss resulting from disclosure of the username or password.
• The user agrees to use their own account personally, and if any other person uses the account, this will be deemed as authorized use on behalf of the account owner.
• The user is obliged to provide true, correct, updated, complete, and lawful information during registration and to update such data whenever necessary.
• The store is committed to handling personal information and contact details with strict confidentiality.
• If the store discovers that untrue, incorrect, outdated, incomplete, unlawful, or Agreement-violating information has been provided, it has the right to suspend, freeze, or cancel the account, without prejudice to the store’s other legal rights.
• In case of non-compliance with any of the above, the store management may stop or cancel membership or block access to store services again.

Article VI: Electronic Communications

• The parties agree that communication will be carried out via the email address registered on the platform.
• The consumer agrees that all agreements, notices, data, and other communications provided electronically shall have the same legal effect as written documents.
• The consumer agrees that the store may contact them and notify them of any provisions related to this Agreement or to their dealings through public or individual electronic messages.

Article VII: Amendments and Fees

• If any provision or clause of this Agreement is canceled or becomes unenforceable, this shall not affect the validity of the remaining provisions, which shall remain in full force.
• This Agreement, as amended from time to time, constitutes the mechanism of work, understanding, and agreement between the consumer and the store.
• The store may impose fees on certain consumers depending on the offers, products, or services they request, or based on fees or taxes imposed by the state on the relevant product or service.
• The store reserves the right to add, increase, reduce, or deduct any fees or expenses under this Agreement from any consumer, for any reason related to their registration or use.

Article VIII: Payment and Payment Services

• The store provides, through its partners, an electronic payment system, and payment may be made fully online using the payment options made available by the store from time to time.
• The store is obliged to determine the prices of the products or services offered in its store in line with recognized market value.
• The store is obliged to provide invoices and receipts for all amounts arising from transactions on the store and to provide the consumer with an invoice for each purchase.
• The store is committed to applying recognized accounting standards in its e-store in accordance with this Agreement and with legal, economic, commercial, and regulatory interests.

Article IX: Intellectual Property

• All intellectual property rights of the store are fully owned by the store, whether acquired before or after the establishment of this electronic platform.
• The consumer shall respect all intellectual property rights of the store, including the store name, wording, logos, and other symbols, which are all considered fully protected intellectual property of the store.

Article X: Store Responsibility

• The store is obliged to conduct its business through this electronic platform in a regular manner and in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia and the provisions of this Agreement.
• The store shall not bear any claims arising from errors or negligence, whether directly or indirectly caused by the consumer or by a third party, such as shipping companies.
• The store, its employees, owners, and representatives are obliged to ensure that the product or service is sound, lawful, and authorized under the laws and regulations of the Kingdom of Saudi Arabia and used for legitimate purposes.

Article XI: Restriction of Access or Membership

• The store may suspend or cancel the consumer’s membership or restrict the consumer’s access to platform services at any time, without prior notice, for any reason and without limitation.

Article XII: Applicable Law

• This Usage Agreement is governed by and construed in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is fully subject to the jurisdiction of the competent authorities in Saudi Arabia.

Article XIII: General Provisions

• If any provision or clause of this Agreement is canceled or becomes unenforceable, this does not affect the validity of the remaining provisions, which shall remain in force until further notice from store management.
• Arabic is the applicable language for interpreting the provisions of this Agreement or translating them into any other language.
• All prices displayed on the store’s products or services may be amended from time to time.
• Promotional or marketing offers launched by the store are temporary, and the store has the right to modify or stop such offers at any time.
• The parties to this Agreement must deal with each other in a manner that does not violate Islamic law, regulations, and applicable laws related to the nature of dealings between the store and the consumer.
• This Usage Agreement may be amended or terminated only by a decision issued by store management.
